Acceptance of Terms

By accessing and using the Quetzal Liveaboard website (quetzalliveaboard.com) and booking our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our website or services.

These terms apply to all visitors, users, and guests who access or use our website or book our expeditions.

Our Services

Quetzal Liveaboard provides liveaboard diving expeditions in the waters of the Mexican Pacific, including but not limited to the Revillagigedo Archipelago (Socorro Islands), the Sea of Cortez, and Magdalena Bay. Our services include accommodation aboard the Quetzal, meals, guided diving, and related activities as described in each itinerary.

All expeditions are subject to availability. We reserve the right to modify itineraries based on weather conditions, safety considerations, or circumstances beyond our control.

Booking Process

Reservations can be made through our website, via email, or through authorized travel agents. A booking is considered confirmed only when we have received the required deposit and have issued a written confirmation.

By making a booking, you represent that you are at least 18 years of age and that all information you provide is accurate and complete. You are responsible for notifying us of any changes to your information before departure.

Pricing & Payment

All prices are listed in US Dollars (USD) unless otherwise stated. Prices include the services described in the specific itinerary and exclude airfare, travel insurance, crew gratuities, dive equipment rental (unless specified), and personal expenses.

A deposit is required to confirm your reservation. The full balance must be paid by the date specified in your booking confirmation. Failure to pay the balance by the due date may result in cancellation of your reservation.

We reserve the right to modify prices at any time. However, confirmed bookings are honored at the price agreed upon at the time of reservation.

Cancellation Policy

Our full cancellation and refund policy is available on the Cancellation Policy page. In summary, refund amounts depend on how far in advance you cancel, with full refunds (minus an administrative fee) available for cancellations made 90 or more days before departure, and no refunds for cancellations made within 30 days of departure.

We strongly recommend purchasing comprehensive travel insurance that covers trip cancellation, interruption, and medical evacuation.

Intellectual Property

All content on this website — including but not limited to text, images, videos, logos, graphics, design, and layout — is the exclusive property of Quetzal Liveaboard or its content suppliers and is protected by Mexican and international copyright, trademark, and intellectual property laws.

You may view and print a single copy of website content for personal, non-commercial use only. Any other use — including reproduction, modification, distribution, transmission, republication, or commercial exploitation — is strictly prohibited without our prior written consent.

The name "Quetzal Liveaboard," the Quetzal logo, and all related names and marks are trademarks of Quetzal Liveaboard and may not be used without our written permission.

User Conduct

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use of, the site by any third party. Prohibited behavior includes:

  • Attempting to gain unauthorized access to our systems or user accounts.
  • Transmitting any harmful code, malware, or spam through our contact forms.
  • Using automated means (bots, scrapers) to extract data from our website without permission.
  • Providing false or misleading information when booking or creating an account.
  • Posting offensive, defamatory, or unlawful content in any interactive areas.

Limitation of Liability

Scuba diving and liveaboard expeditions involve inherent risks that cannot be eliminated. Quetzal Liveaboard, its owners, employees, crew, and agents shall not be held liable for any injury, loss, damage, delay, or expense arising from: acts of nature, weather conditions, mechanical failures, actions of third parties, government actions, or any other circumstances beyond our reasonable control.

Guests are required to sign a Liability Release and Assumption of Risk Agreement before participating in any diving activities. By using our services, you acknowledge that you have read and understood our Diving Risks, Safety & Responsibilities page.

To the fullest extent permitted by Mexican law, Quetzal Liveaboard's total liability for any claim arising from your use of our website or services is limited to the amount paid by you for the specific service giving rise to the claim.

Our website may contain links to third-party websites, including travel insurance providers, dive certification agencies, and partner organizations. These links are provided for your convenience only. We do not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party sites.

Modifications to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of our website after any changes constitutes acceptance of the modified terms. We encourage you to review these terms periodically.

Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of the United Mexican States, specifically the state of Baja California Sur. Any dispute arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of La Paz, Baja California Sur, Mexico.

For users residing in the European Union: nothing in these terms affects your statutory rights under EU consumer protection law, including the right to bring a claim in your local courts. The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

For users residing in the United States: these terms do not limit any rights you may have under applicable US federal or state consumer protection laws. California residents are entitled to specific disclosures under the California Consumer Privacy Act — please refer to our Privacy Policy for details.
